Biography

Jan Stamm has been a partner with the law firm of Barber, Kaper, Stamm, McWatters, Whitlock & Maloney, LLP since 1981. He has over 30 years of experience with estate planning, commercial and residential real estate, creditor’s rights, personal injury/wrongful death claims, probate, business litigation and corporate law.

Mr. Stamm received a B.A. from Goshen College in 1974 and received his law degree from Case Western Reserve University Law School in 1978. During law school, he was a member of the Moot Court Board.

He was the City of Wauseon Law Director from 1986-1988, Assistant City of Wauseon Law Director since 1989, Solicitor for the Village of Lyons from 1990-1995, and Assistant Village Solicitor for the Village of McClure from 2002 to 2009.

His experience has also included success at the appellate level, including Toledo Edison Co. v. Allen (1983), 13 Ohio.App.3d 108 (municipal court authority to order debtor’s examinations and compel appearance by warrant). Mr. Stamm also received a favorable outcome in representing the City of Wauseon in City of Wauseon v. Badenhop, 9 Ohio St.3d 152.

Mr. Stamm has been a facility presenter with Lorman Education Services for a seminar entitled “Judgment Enforcement in Ohio” in 2003 and 2004, was a member of the non-profit Board of Trustees of Quadco Rehabilitation Center, Inc. (a sheltered workshop) from 1985-1992, and has been counsel for many charitable organizations including Pettisville School Foundation, area churches, and various community outreach organizations.

Mr. Stamm is licensed to practice in all courts in the State of Ohio, the U.S. District Court, Northern District of Ohio, the U.S. District Court, Southern District of Ohio, and the United States Court of Appeals for the Sixth Circuit. He is also a member of the Fulton County Bar Association (President 2002), Ohio State Bar Association, Michigan Bar Association, Commercial Law League of America, and Ohio Trial Lawyers Association.

Biography

Thomas A. McWatters III has been a resident of Fulton County for over 30 years. He received a Bachelor of Science Degree in Mathematics from Taylor University in 1982 and graduated Magna Cum Laude from the University of Toledo, College of Law in 1986, where he was a member of the Law Review, National Moot Court Team, and was elected to the Order of the Coif. He was named the Outstanding Oral Advocate in the Twelfth Annual Fornhoff Competition. Mr. McWatters also holds a Ph.D. in philosophy from Duke University and an M.A. in philosophy of religion in ethics from Biola University.

Prior to beginning his private practice, Mr. McWatters served as a federal law clerk to the Honorable James Harvey, Senior District Court Judge, United States District Court, Eastern District of Michigan (1986-1988), and the Honorable Charles E. Wiggins, United States Circuit Court Judge, United States Court of Appeals, Ninth Circuit (1988-1989).

Following his judicial clerkships, Mr. McWatters began his legal practice in the Los Angeles office of Sidley Austin LLP, specializing in complex business litigation. After his return to Northwest Ohio, Mr. McWatters joined Barber, Kaper, Stamm, McWatters, Whitlock & Maloney, LLP in 2007, becoming a partner in 2010.

Mr. McWatters represents a broad variety of individual and institutional clients. His legal practice focuses on civil litigation, including commercial and business litigation, creditor’s rights, municipal law, landlord-tenant law, real estate disputes, and personal injury claims.

Mr. McWatters has served as the Law Director for the City of Wauseon since 2011. He served as Wauseon’s Assistant City Law Director from 2006-2010. Mr. McWatters was appointed Special Counsel for the Ohio Attorney General on February 18, 2015.

Mr. McWatters is active in the Fulton County and Wauseon communities. He was a member of the board of directors of the CPC Women’s Health Resource for six years, four years of which he served as Board Chair. He was co-director of the annual Wauseon Tomahawk Trot 5k for ten years. He is a member of the Wauseon Rotary Club, and services as the chair of the club; Indian Hills Trials Committee. Mr. McWatters is also a member of the Pettisville School Foundation.

Mr. McWatters is licensed in both state and federal courts in the states of Ohio and California. He is a member of the Ohio State Bar Association, the Fulton County Bar Association, and the California State Bar.

Biography

Kevin is a lifetime resident of Northwest Ohio. He obtained his legal degree at the University of Toledo, College of Law, graduating in 2007. Kevin attended Defiance College, graduating magna cum laude in 2002 with a Bachelor of Arts Degree in Business Management. Kevin also holds a degree in Mechanical Engineering Technology from Northwest State Community College.

Kevin J. Whitlock joined Barber, Kaper, Stamm, McWatters, Whitlock & Maloney, LLP after law school, and became partner in 2018.

Kevin devotes the majority of his practice to real property law, creditor’s rights, and domestic relations. He also practices in the areas of personal injury and litigation.

In addition to his legal background, Kevin brings a wealth of life experiences to Barber, Kaper, Stamm, McWatters, Whitlock & Maloney, LLP. Prior to practicing law, Kevin was employed as an engineer for 17 years at Sauder Wood Working. He has also been active in community affairs including as a member of West Unity Village Council, an appointee to the Williams County Board of Elections, and an appointee to the Williams County Regional Planning Commission.

Mr. Whitlock is licensed to practice in all courts of the State of Ohio and is a member of the American Bar Association, the Ohio Bar Association and the Fulton County Bar Association. Mr. Whitlock also currently serves as a member of the Fulton County Advisory Board for the State Bank And Trust and the Northwest State Community College Foundation Development Committee.

Biography

Stephen M. Maloney joined the firm in 2016, and became a partner in 2021. Stephen’s practice consists primarily of litigation, business formation and corporate law, commercial and residential real estate, estate planning and probate, creditor’s rights, personal injury, and immigration law.

Stephen earned a B.A. from Miami University in 2010 in Zoology and Economics. He earned his J.D., magna cum laude, from The University of Toledo College of Law in 2014. During law school, Stephen served as an editor of The Toledo Law Review and clerked for several law firms and organizations in the areas of health care, taxation, and insurance defense. In addition, Stephen externed for the Honorable Magistrate Judge James R. Knepp, II of the U.S. District Court for the Northern District of Ohio.

Stephen comes from a long line of business owners and began his first business in 2010. He is passionate about entrepreneurship and efficiency consulting with an emphasis on the implementation of new technology.

Stephen now lives in Wauseon, Ohio and is actively involved in his community. He currently serves as a board member of the Wauseon Chamber of Commerce, Wauseon Rotary Club, and Triangular Processing, Inc.

Stephen is licensed to practice in all state courts in Ohio, and the U.S. District Court, Northern District of Ohio, Southern District of Ohio. He is a member of the Ohio State Bar Association, and the Fulton County Bar Association.

Biography

Kayla is the newest addition to Barber, Kaper, Stamm, McWatters, Whitlock & Maloney, LLP, joining the firm in 2017. She devotes most her time to creditor’s rights, civil litigation, and personal injury. She also currently serves as a guardian ad litem for Williams, Henry, Defiance, and Fulton Counties.

A Virginia native, Kayla earned her B.A. from the University of Mary Washington in Fredericksburg, Virginia. She earned her law degree from Case Western Reserve University School of Law, graduating cum laude in 2016. While in law school, Kayla served as a researcher’s assistant, a legal writing tutor, and the treasurer of the Student Bar Association.

Prior to joining BKSMW, Kayla served as an extern to the Honorable Donald C. Nugent, United States District Court Judge, Northern District of Ohio. She also worked as a law clerk for a prestigious Cleveland personal injury firm during her final year in law school.

Kayla now resides in Wauseon, and is active in the community. She currently volunteers with homeless shelters and the Humane Society, passions that she discovered in high school. In addition, Kayla is a member of the Wauseon Rotary Club, the Fulton County Historical Society, and is President of the Wauseon Beautification Team, a non-profit organization she helped found. When not practicing law, she enjoys soccer, gardening, and spending as much time as possible with her nieces.

Kayla is licensed to practice in all state courts in Ohio, all federal courts in Michigan, and is a member of the Ohio Bar Association and the Fulton County Bar Association.
